Contract

The placing of an order with us does not constitute a contract.  The contract is formed only when your order is expressly accepted.  Acceptance of an order will be subject to:

• The products ordered are available from stock
• Our obtaining authorization for payment
• You’re over the age of 18
• The identification of a pricing or product description error, in which case we will contact you to check whether you wish to proceed with or cancel the purchase of that item

Title

Title in the wines will pass to you when you have paid for such wines in full.

Age

In order to purchase wines or other alcoholic beverages from us you must be at least 18 years old.

Payment Terms

Payment will be due immediately upon the issuance of an invoice to you, or on such terms as may otherwise be agreed.

Delivery

Bermuda delivery is free for all wine orders of $200 and over.  Orders under $200 are chargeable at $25 per delivery.  Orders will be delivered as soon as is reasonably possible after receipt of the order.  

If you have any specific delivery requests or timing issues, please advise us at the time of the order.

Warranty

We do not warrant as to the taste or drinkability of wines purchased as drinkability, and taste are subjective judgments.

Liability

We will not be liable to you or to any other party following the onward sale of wines purchased from us by you.

Faulty Wines

Provided that

1. Wine purchased from us has been properly stored and does not evidence signs of being exposed to heat (vital in Bermuda’s climate where exposure to heat can result in the rapid deterioration and spoilage of wine);
2. The wine is within the generally accepted drinking window;
3. We have not advised you that we will be unable to provide a refund or replacement for reasons of age or provenance;

Then, if a bottle of wine is corked, oxidized, or otherwise defective, we will replace such bottle with another bottle of the same wine (or, if not available, with another bottle of equivalent value).  We reserve the right to ask you to provide the bottle for inspection within a reasonable period.
